These Terms and Conditions are based on the definitions set out in the General Terms and Conditions for the Purchase of Tickets (hereinafter referred to as the Ticket Sales GTC), as well as the Terms and Conditions of the funcode.hu marketplace (hereinafter referred to as the funcode.hu T&C).

The precise definitions of any newly introduced terms are provided in this section. In addition, where it aids readability, such newly introduced terms are indicated at their first occurrence in italics and with initial capital letters.

FunPassThe website available at [https://www.funcode.hu/funpass] and its subpages (the Website), on which tickets for Events are listed where the Event Organisers and the Merchants entrusted with the distribution of such tickets have given their prior consent for ticket holders to transfer the seat represented by their purchased ticket to another end user for the purpose of purchasing a new ticket. By doing so, the original ticket holder waives their right to occupy the seat represented by the ticket, to attend the Event, and, in general, all rights arising from the purchase transaction associated with the ticket, while being entitled to request a full or partial refund of the participation fee included in the ticket from the Merchant.
UserA natural or legal person using the FunPass service who has reached the age of 18.
(Primary) TicketholderThe Ticket Holder as defined in the Ticket Sales GTC who has purchased the ticket themselves, holds the purchaser and holder rights associated with the ticket purchase, and who, within the framework of the FunPass service, intends to waive these rights in favour of a new purchaser by having their ticket invalidated and requesting a refund of the participation fee paid by them.
(Secondary) Ticket PurchaserThe Purchaser as defined in the Ticket Sales GTC who, within the framework of the FunPass service, intends to acquire the purchaser and holder rights held by the Primary Ticket Holder through the service.
Operator, or Showtrade Kft.The owner and operator of the FunPass service (the Operator).
  1. These Terms and Conditions set out the conditions for the use of the FunPass service.
  2. The Operator is independent from the Merchant and, within the framework of the FunPass service, provides an autonomous informational and intermediary service, and does not carry out any commercial activity.
  3. These Terms and Conditions expressly do not apply to the sale of tickets offered by individual Merchants or to any related services or products. The Operator expressly and emphatically draws the Users’ attention to the fact that FunPass is a service within which, in relation to the actual refunding and resale of tickets, the purchaser does not enter into a legal relationship with the Operator, but with the Merchant(s), being legal entity/entities, responsible for the actual sale of the given Events. Showtrade Kft., in its capacity as the operator of the FunPass service, does not carry out any commercial activity through the service.
  4. In the course of its activities, the Operator acts as an informational intermediary and facilitates the resale of seats represented in the tickets of Primary Ticket Holders, sold by various Merchants, to end users by collecting and making this information accessible to Users through the FunPass service. Furthermore, it enables the Primary Ticket Holder to waive their rights and obligations represented by the ticket and transfer them to the Secondary Ticket Purchaser.
  5. The FunPass service is not available in the same way for all Event Tickets sold in the funcode.hu online store.
  1. Within the framework of the FunPass intermediary service, the Primary Ticket Holder sells, and the Secondary Ticket Purchaser purchases, the purchaser and holder rights represented by the Primary Ticket Holder’s tickets (hereinafter: the Ticket Sale).
  2. The Operator’s service via the FunPass service is limited solely to notifying the Merchant, simultaneously and at the same time, of the Primary Ticket Holder’s intention to sell and the Secondary Ticket Purchaser’s corresponding intention to purchase. The actual sale is carried out by the Merchant through their own webshop.
  3. During the Ticket Sale, tickets may only be sold at their original face value and cannot be sold at any other price.
  4. In the case of a successful Ticket Sale, the Merchant carries out two transactions simultaneously: on the one hand, it invalidates the original purchase transaction of the Original Ticket Holder, and on the other hand, it creates a new purchase transaction for the Secondary Ticket Purchaser.
  5. The Ticket Sale service is subject to a fee (hereinafter: the FunPass Fee), the amount of which is determined by the Merchant. The Original Ticket Holder is entitled to decide, at the time of listing the tickets, who shall bear this fee. The Original Ticket Holder may choose to bear the full FunPass Fee, share it equally with the Secondary Ticket Purchaser, or pass the full amount on to the Secondary Ticket Purchaser. Both the Original Ticket Holder and the Secondary Ticket Purchaser accept the FunPass Fee, and by using the Ticket Sale service, the Secondary Ticket Purchaser accepts the Original Ticket Holder’s decision regarding the party responsible for payment of the fee, and shall not dispute it either in principle or in amount.
    EXAMPLE: The Primary Ticket Holder has one ticket with a face value of HUF 10,000 in their Purchase Transaction, which they list for sale with the intention of sharing the 10% FunPass Fee equally with the Secondary Ticket Purchaser. In the event of a successful sale, the Original Ticket Holder receives a refund of HUF 9,500 from the Merchant (10,000 – 1,000 × 0.5), while the Secondary Ticket Purchaser pays HUF 10,500 to the Merchant as part of the Purchase Transaction (10,000 + 1,000 × 0.5).
  6. In the event of a successful Ticket Sale, the Merchant cancels the original Purchase Transaction of the Primary Ticket Purchaser, invalidates the tickets contained therein, and refunds to the Primary Ticket Purchaser the face value of the tickets included in the original Purchase Transaction, reduced by the portion of the FunPass Fee payable by the Original Ticket Holder (hereinafter: the Refund of the Original Purchase Transaction).
  7. The Refund of the Original Purchase Transaction is carried out via a so-called Refund of the Online Purchase Transaction to the bank card used for the original purchase. Refunds to any other person, card, account, or by bank transfer are not possible.
  8. In the event of a successful Ticket Sale, the Merchant issues a corrective invoice to the Primary Ticket Purchaser based on the billing details provided in the original Purchase Transaction.
  9. In the event of a successful Ticket Sale, the Merchant creates a new Purchase Transaction for the Secondary Ticket Purchaser, the ticket content of which is identical to that of the Primary Ticket Purchaser’s original Purchase Transaction, supplemented by the FunPass Fee, where such fee is payable by the Secondary Ticket Purchaser.
  10. In the event of a successful Ticket Sale, the Merchant does not refund to the Primary Ticket Purchaser any transaction, ticket issuance, system, delivery, or other fees related to the purchase of the tickets (if such fees were actually paid), as these constitute fees for services that have already been duly performed in the past and cannot be reversed. At the same time, such fees (if applicable at the time of the Ticket Sale) are charged to the Secondary Ticket Purchaser as fees for services actually provided specifically to them.
  11. The fees applied during the Ticket Sale are displayed by the Operator at the earliest possible stage of the purchase process, prior to the creation of the actual Purchase Transaction, and are clearly separated from the face value of the tickets. These fees are also displayed in the Merchant’s webshop during the creation of the new Purchase Transaction. In the event of any discrepancy between the fees displayed on the two interfaces, the fees displayed in the Merchant’s webshop shall prevail.
  12. During the Ticket Sale, only entire Purchase Transactions may be sold; a Purchase Transaction cannot be split, and individual tickets within it cannot be sold separately.
  13. During the Ticket Sale, the Primary Ticket Holder and the Secondary Ticket Purchaser do not come into contact with each other and do not enter into any legal relationship; their identities remain undisclosed to one another.
  14. The Primary Ticket Holder lists their ticket for sale with the understanding that, in the event of a successful sale, they will lose all rights and obligations associated with the ticket at the moment of the sale.
  15. The Primary Ticket Holder may withdraw/remove the listing of their ticket at any time until it has been successfully sold. A ticket that is currently under sale cannot be withdrawn/removed from listing. Tickets that have been sold are automatically removed from the listing.
  16. The rights and obligations of the Secondary Ticket Purchaser arising from Purchase Transactions initiated via the FunPass interface are identical to those of purchasers acquiring tickets through the primary sales interface.
  1. Within the framework of the FunPass service, the Primary Ticket Purchaser may initiate the listing of their tickets by clicking the “Sell My Tickets” button on the service interface or the “Sell Ticket” button on the funcode.hu event page.
  2. In order to list tickets, the Primary Ticket Holder must provide the email address used for the original Purchase Transaction. If the identification is successful, all Purchase Transactions of the Ticket Holder will be displayed on the FunPass interface, with those eligible for resale shown under the “Tickets available for resale” section. The listing process can be continued by clicking the “Details and Sell” and then the “Sell” button within the transaction.
  3. On the next page, the Ticket Holder must specify who will bear the FunPass Fee. Additionally, the Ticket Holder may provide custom attributes and free-text information related to the transaction. The Operator assumes no responsibility for the accuracy of the custom attributes and the information indicated in the free-text field, both provided by the Primary Ticket Holder.
  4. After providing the required information and accepting the Terms of Use, the tickets will be listed on the FunPass interface.
  5. Tickets that have already been listed for sale can be found on the user interface under the “Listed Tickets” section. By clicking the “Details and Modify” button, the listing can be modified, or by clicking the “Remove Listing” button, the listing can be removed.
  6. If a Secondary Ticket Purchaser has added a listed transaction of the Primary Ticket Holder to their cart, it is temporarily not possible to modify or remove that listing.
  1. Users can view a list of Events available through the FunPass service, sorted according to various criteria, either via the FunPass interface or the funcode.hu homepage. The selection of display criteria is at the sole discretion of the Operator.
  2. By clicking on an Event of interest, the User is taken to the Event’s subpage, where the seats and tickets available for purchase through the service are presented in detail.
  3. Users have the option to search for a specific seat under various filtering conditions.
  4. The User initiates the ticket purchase process by clicking the button located under the desired seats or sectors. On the following page, a detailed list of seats offered for sale in that area or sector is displayed, grouped according to the original Purchase Transactions. The User may indicate their intention to purchase the seats in the transaction by clicking the “Details and Buy” button. Purchase Transactions can only be completed in full; the tickets contained within cannot be purchased individually.
  5. On the next page, the seats offered for sale and the details of the associated tickets are presented, along with the attributes provided by the seller of the seats. The face value of the tickets, the relevant FunPass Fee, and any other ticket issuance, system and transaction fees associated with the purchase of new tickets are also displayed. The purchase process can be continued by clicking the “Add to Basket,” “View Basket,” and “Finalize purchase” buttons. Completion of the checkout requires the acceptance of the User Declarations, including the Terms & Conditions and Privacy Policy displayed on FunPass.
  6. By clicking the “Finalize purchase” button, the Consumer is redirected to the Merchant’s webshop, where a Purchase Transaction prepared according to the Consumer’s request is presented. At this point, FunPass, as an independent service, concludes, and the Purchase Transaction continues under the rules set forth in the Merchant’s Ticket Sale Terms and Conditions within the Merchant’s webshop.
  1. The content related to Events, Tickets, and seating presented through the FunPass service, as well as the displayed ticket prices, data, and information, are subject to continuous change due to the nature of the service. The Operator makes every effort to present up-to-date information within the Service; however, as the information displayed in the Service, including the list of Events, their descriptions, and ticket prices, originates from and is managed by the Merchants themselves, the Operator does not assume any responsibility for the accuracy, timeliness, or availability of such information and cannot be held liable for any damages related thereto.
  2. The Operator draws the Users’ attention to the fact that the information displayed within the Service (including, but not limited to, information regarding ticket availability and prices) is provided for informational purposes only due to the nature of the Service and may differ from the information found in the Merchants’ webshops or other platforms and used during the actual sale. In such cases, the information actually presented by the Merchant shall prevail.
  3. The Operator is not responsible for notices, offers, or contracts found within the Service and/or in the Merchants’ webshops that do not originate from the Operator, nor for their non-fulfillment or termination, including, in particular, the correctness, quality, usability of issued Tickets, the quality, safety, and legal compliance of Events. The Operator does not undertake any obligation to verify such information and is not liable for its accuracy. The Operator does not mediate or interfere in disputes, legal matters, or transactions between Users and Merchants or Event Organizers; in the absence of statutory and/or contractual obligations, it is not in a position to do so.
  1. The Operator does not require Users to register in order to browse the Events, Tickets, or seating available through the FunPass service. However, Merchants may require registration for actual ticket purchases. In such cases, the registration requirements are specified in the Merchant’s Ticket Sale Terms and Conditions.
  2. The Operator provides the FunPass intermediary service to Users free of charge. During the actual ticket purchase, the Buyer pays the ticket price, the FunPass Fee, and any additional participation, ticket issuance, or other fees over the ticket price directly to the Merchant. The Operator is not a party to these transactions and does not contractually participate in them.
  3. The FunPass Fee for successful Purchase Transactions facilitated through the FunPass service is charged by the Merchant recording the Purchase Transaction to the Buyer and/or the original Ticket Holder. The FunPass Fee is paid to the Merchant as part of the Purchase Transaction or indirectly, through compensation from the amount to be reversed during the Reversal of the Purchase Transaction.
  4. The delivery, shipment, or handover of tickets sold in webshops to Buyers, as well as the handling of tickets after sale, is carried out independently of the Operator, in accordance with agreements between Merchants and Buyers. The Operator assumes no responsibility for any errors that may occur.
  1. Trademarks and logos related to FunPass and funcode.hu displayed within the FunPass service are the exclusive property of the Operator — excluding widely used universal logos that do not belong to any specific rights holder. These designations may not be used without the express prior written consent of the Operator; they may not be used, copied, distributed, or published by third parties.
  2. The User acknowledges and accepts that images, articles, texts, videos, and graphic designs displayed in connection with Events through the Service are or may be protected by copyright. The rights to such content belong to the Merchant, as well as the rights holders authorized or appointed by the Merchant to use the Service. Information and other Event-related materials available through the Service may not be used, copied, distributed, or published by third parties for purposes other than the Service without the express prior written consent of the Merchant and the Rights Holders.
  3. The sources of content, trademarks, images, videos, audio materials, text materials, and other digital content displayed in connection with individual Events are provided to the Operator by the respective Merchant, and are presented by the Operator in the FunPass service in their original form. The Operator does not alter, reduce, or modify these materials and, based on its agreements with the Merchants, assumes no responsibility for them. Accordingly, the Operator does not verify the authenticity of these materials or their rights holders. If any claims or complaints arise regarding these materials, they may be addressed directly to the respective Event Merchant; the Operator excludes all liability in this regard.
  1. The User may contact the Operator of the Service via the contact details provided on the “Contact Us” page under the “About Funcode.hu” menu in the footer of the Service.
  2. The User/Buyer may contact Merchants through the contact options available in the footer of the respective Merchant’s subpage.
  3. If, in the Operator’s assessment, traffic from a given internet network exceeds normal levels, the Operator reserves the right to implement a “captcha” verification for Users, and to restrict or block access for Users whose activities may jeopardize the smooth operation of the Service or may cause damage to the Operator.
  4. FORCE MAJEURE: This term refers to any cause, event, or circumstance that is unforeseeable, uncontrollable, and/or independent of the Operator but affects its activities, making it impossible for the Operator to fulfill the obligations undertaken in these Terms of Use. The Operator shall not be held liable for non-performance or faulty performance of its obligations if such failure is partly or entirely caused by a Force Majeure event.
  1. The Operator does not process any personal data related to natural persons in connection with the operation of the FunPass service, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
  2. Each Merchant’s privacy policies regarding the processing of personal data can be found in the footer of their own Webshop.
  3. To ensure the proper operation of the FunPass service, to further develop the service, and to enhance the user experience, the Operator uses or may use cookies—small text files stored on the User’s computer. Users can manage cookie settings in their browser preferences. Refusal to accept cookies does not prevent use of the service, but some elements of the service may not function properly. Session cookies never collect any information that could identify the User.
  4. To improve the efficiency of the FunPass service and monitor appropriate user diagnostics, the Operator uses Google Tag Manager on the service pages. Except for data included in standard HTTP request logs and certain diagnostic data, the tag manager does not collect, store, or share any User-related data during the use of the service.
  1. These Terms of Use come into effect at the publication time indicated on the first page and remain in effect for an indefinite period; in terms of content, Hungarian law and the applicable European Union law shall apply.
  2. The Operator is entitled to unilaterally modify these Terms of Use. In such cases, the Operator will present the revised version, consolidated into a single document, as the effective version on the Marketplace pages.
